Following terms and conditions:
1. Proofreading is the responsibility of the client. Realtywriters Pty Ltd, while taking all care possible, is not responsible for omissions, mistakes or errors once published. As a matter of policy, editing of images is restricted to minor digital alterations of photographs that do not seek to falsely misrepresent a property.
2. Realtywriters Pty Ltd reserves the right to use all images and copywriting in promotion of its products and company, unless directed not to do so.
3. Copyright information. A photograph is considered intellectual property. The photographer owns the copyright to the images he or she creates and has the exclusive right to license their use. Licensing agreements are specific with regard to use. Simply having physical possession of photographs, slides, prints, transparencies or digital files does not grant the right to use them. In using the photography supplied to you on disc or electronically, you are agreeing to the following terms and conditions:
Usage of photography.
Unless otherwise stated in writing by Realtywriters Pty Ltd , any photography supplied by Realtywriters Pty Ltd now or in the future is to be used for real estate marketing purposes only. Copyright is held by Realtywriters Pty Ltd, and is not transferable.
Photography is to be used for the original marketing campaign by the original real estate agency only. The current owner of the property (at the time the order is placed with Realtywriters Pty Ltd) may also use the photographs as a personal memento, but does not retain any copyright for commercial purposes. Any request for publication/sub-licensing of photographs (via print or internet or any other medium) taken by Realtywriters Pty Ltd, which is outside the specified original marketing campaign (including any use by architects, builders, painters, kitchen suppliers, stylists and any print or web publications), must be made in writing to Realtywriters Pty Ltd, for our consideration. Stock images supplied from our library are strictly intended for single use only and not to be held for use in future marketing campaigns. No alteration or manipulation of the image may be made without the permission of Realtywriters Pty Ltd.
4. If full payment of the supplied invoice is not made within the terms stated on the invoice you may be charged an additional fee of 5% of the total invoice.
5. Any breaches in copyright will be pursued vigorously.
6. The photographer shall not be liable for any legal action, claim or damages resulting from or arising out of the publication of the photographs or other use.
7. Photography for purposes other than Real Estate marketing. Please note, in using the photography supplied to you on disc or electronically, you are agreeing to the following terms and conditions: Usage is as per original written agreement. If there is no written agreement, usage is for one media only and limited to 1 year use beginning from shoot date. Copyright is held by Realtywriters Pty Ltd, and is not transferable. Rights for conditional, non-exclusive usage are licensed only upon full payment of the invoice. If any images are used prior to full payment you are in breach of copyright. Any request for publication/sub-licensing of photographs (via print or internet or any other medium) taken by Realtywriters Pty Ltd, which is outside the specified agreement , must be made in writing to Realtywriters Pty Ltd, for our consideration. No alteration or manipulation of the image may be made without the permission of Realtywriters Pty Ltd. Any breaches in copyright will be pursued vigorously.
